TERMS AND CONDITIONS
GENERAL This purchase is governed by the standard terms and conditions for consumer purchases of goods over the Internet. A consumer purchase means the sale of goods to a consumer who is not primarily acting as part of business activity, and where the seller is engaged in business activity selling goods online.
Consumer purchases are regulated by, among other laws, the Norwegian Consumer Purchase Act and the Right of Withdrawal Act.
AGREEMENT The agreement between the buyer and the seller consists of the information provided by the seller about the purchase in the online store checkout process (including information about the nature, quantity, quality, other characteristics, price, and delivery terms), any direct correspondence between the parties (e.g., emails), and these terms and conditions.
If there is a conflict between information provided in the checkout process, direct correspondence between the parties, and these terms, then the checkout information and correspondence shall take precedence, provided it does not contradict binding legislation.
PARTIES Seller: Company: UPURUKARLSEN Email: upurunorge@gmail.com Organization number: 932 429 810
Buyer: The person placing the order.
CUSTOMS AND SHIPPING Private individuals in Norway do not pay customs duties on custom air fresheners, as they are made in Norway. However, customs duties and other fees may apply to products not produced in Norway.
For customers outside Norway, the customer is responsible for paying any applicable customs duties and taxes according to the laws of their country.
PRICES Prices listed in the online store does not currently include VAT/MVA unless the buyer is from Norway. Deliveries abroad, to countries outside of Norway are sold without VAT.
CONCLUSION OF AGREEMENT The agreement is binding when the seller receives the buyer's order. However, if there is a typographical or input error in the seller's offer or the buyer's order, and the other party knew or should have known that such an error occurred, neither party is bound by the agreement.
ORDER CONFIRMATION An order confirmation is sent via email immediately after purchase. Buyers are encouraged to review the confirmation to ensure it matches their order. If there are discrepancies, the buyer should contact the seller as soon as possible.
PAYMENT The seller may require payment when the item is shipped. If the buyer uses a credit or debit card, the seller may reserve the purchase amount at the time of order.
A credit card is a payment card where payment occurs later via an invoice from the card issuer. A debit card is linked to a deposit account, and the amount is charged directly.
For credit card payments, the Norwegian Credit Purchase Act applies.
DELIVERY Delivery is made as stated in the online store or in the order confirmation. If not specified, the seller must deliver within a reasonable time, and no later than 30 days after the order. If the seller arranges shipping, they are responsible for ensuring proper and timely delivery to the agreed destination.
TRANSFER OF RISK The risk transfers to the buyer when the product is received. If the buyer fails to collect the item after it is made available, they still bear the risk of loss or damage.
RIGHT OF WITHDRAWAL Buyers may cancel the purchase under the Right of Withdrawal Act. This allows the buyer to return the item without reason within 14 days after receiving the item and the withdrawal form.
If the buyer receives the withdrawal form and information after the item, the withdrawal period begins upon receipt of that information. If the buyer does not receive sufficient information, the withdrawal period is extended to 3 months. If no information is provided, the period is 1 year.
Withdrawal notice should be in writing (form, email, fax, or letter) and include how the item will be returned.
The item must be returned within 14 days of withdrawal notice, unless the seller offers to collect it.
If the buyer chooses a more expensive delivery than standard, the seller is not obligated to refund the extra cost.
Refunds must be made within 14 days of the withdrawal notice. The seller may wait until the item is received or proof of return is provided. No fees will be charged for the refund.
The buyer must cover return shipping costs.
The buyer may inspect the product but must return it in approximately the same condition. The seller may deduct for depreciation if the product is used more than necessary.
Whenever possible, the item should be returned in original packaging.
Items not suitable for return due to hygiene, or perishable goods, and unsealed software/media are excluded from withdrawal.
INSPECTION OF THE PRODUCT Buyers are encouraged to inspect the item upon delivery for damage or defects. If there is an issue, the buyer must notify the seller as per the complaint section. Buyers acknowledge that custom air fresheners may have print lines or slight trimming offsets (up to 2mm), which are standard.
COMPLAINTS AND DEADLINES If there is a defect, the buyer must notify the seller within a reasonable time and no later than two months after discovering it. Complaints must be made within two years, or five years for long-lasting items.
For late delivery, the complaint must be made promptly. Credit card purchases may be reported directly to the card issuer. The complaint should preferably be in writing.
BUYER'S RIGHTS IN CASE OF DELAY If delivery is delayed and not the buyer’s fault, the buyer may withhold payment, demand fulfillment, cancel the order, or claim compensation under the Consumer Purchase Act.
Fulfillment: The buyer may require delivery within a reasonable additional period unless it's impossible or unreasonably burdensome.
Cancellation: The buyer may cancel the order if the delay is substantial or the seller fails to deliver within the extended deadline.
Compensation: The buyer may claim compensation for losses due to delay.
BUYER'S RIGHTS IN CASE OF DEFECT If there is a defect, and the buyer is not at fault, the buyer may withhold payment, demand repair or replacement, request a price reduction, cancel the purchase, or claim compensation.
Repair/replacement must be done within a reasonable time, at no cost or risk to the buyer. The seller may not attempt more than two repairs unless reasonable.
Price reduction: If repair or replacement fails, the buyer may demand a proportionate price reduction.
Cancellation: If the defect is not minor and cannot be resolved, the buyer may cancel the purchase.
Compensation: The buyer may claim compensation for losses resulting from the defect.
SELLER'S RIGHTS IN CASE OF BUYER’S BREACH If the buyer fails to pay or meet obligations, and the fault lies with the buyer, the seller may withhold delivery, demand performance, cancel the agreement, and claim compensation. Interest, collection fees, and uncollected item fees may also apply.
Uncollected item fee: If the buyer fails to collect non-prepaid goods, the seller may charge return shipping and other expenses. This only applies to adults.
For custom orders, production will begin after order confirmation. Once production has started, the order is binding and cannot be cancelled. The buyer is liable for the full amount regardless of payment status.
“Custom-made products are exempt from the right of withdrawal under Angrerettloven § 22 e. If such products are not collected by the buyer, the seller may charge actual return shipping and handling costs. No refund will be given.”
GUARANTEE Any guarantee provided by the seller or manufacturer gives additional rights beyond mandatory consumer rights.
PERSONAL DATA The seller may only collect necessary personal data for fulfilling the agreement. For buyers under 15, parental consent is required. Data is only shared when necessary or legally required.
If personal data is used for marketing, explicit consent is required.
Buyers may contact the seller to inquire about, correct, or delete their data.
COOKIES Our online store uses cookies. You can browse without cookies, but you cannot make a purchase. Cookies are used to manage the shopping cart. If cookies are blocked, the site may not function properly.
DISPUTE RESOLUTION The parties should try to resolve disputes amicably. Buyers may contact the Norwegian Consumer Council. If mediation fails, the case may be referred to the Consumer Disputes Commission. Their decision is binding after 4 weeks unless challenged in court.
